PURPOSE OF THIS PRIVACY NOTICE.

  • Exel Consultancy arranges deals on behalf of clients in certain products. Exel Consultancy also introduces clients to platform providers, who will then arrange deals as instructed by the client. Platform and product providers are responsible for safeguarding and administering investments, including specific charges to their products. Investments into any products offered on the website are carried out on the instructions of the client.
  • Exel Consultancy will not provide advice nor exercise any judgement on the client’s behalf as to the merits or suitability of any products offered on the website.
  • For the purposes of client categorisation, and as per the FCA’s Retail Distribution Review (RDR directive), that is required by the FCA Rules, Exel Consultancy will treat you as a retail client. Exel Consultancy may also categorise clients as a retail client and any other client who would otherwise be a professional client or an eligible counterparty (as defined in the FCA rules).
  • If you are acting as an agent for someone else, Exel Consultancy will treat you alone as its client and you will be liable to Exel Consultancy in respect of transactions you conduct in such capacity.
  • Exel Consultancy does not hold client money as defined by the FCA’s Client Money rule.
  • Exel Consultancy has implemented a conflicts of interest policy to ensure fair treatment of its clients under which it will not carry out transactions for clients in the products of companies in which Exel Consultancy or any director or employee or one of its other clients has a known significant personal interest unless that interest is first disclosed. This policy shall not apply to personal holdings of directors and staff in investments transacted by Exel Consultancy in the normal course of business.
  • Written communication or online instructions (including email instructions from an email address which you have provided to us) will normally be required before Exel Consultancy will act for the client but oral instructions at Exel Consultancy discretion will also be acceptable. Authority to act on behalf of the client may be terminated at any time without penalty by either party giving notice in writing or by e-mail to the other. Such termination will not affect the completion of any transaction already initiated on your behalf.
  • Exel Consultancy acts as the client’s agent in arranging investments, and never owns investments it arranges for them.
  • All investments will be registered in the name of the client(s). Contract notes and documents of title are normally sent direct to the client by the product provider, but if they have been sent to Exel Consultancy, they will be forwarded to the client no later than the first business day following their receipt by Exel Consultancy. However, when a number of contract notes or documents’ relating to a series of transactions is involved, they may be retained by Exel Consultancy until the series is complete.
  • All application forms, contract notes, cheques, certificates or documents of title may be sent by post at the client’s risk.
  • Exel Consultancy accepts no liability to clients who purchase two ISAs in one fiscal year, or otherwise do not comply with ISA rules.
  • Exel Consultancy may receive commission from product providers following arrangement of investments, and this is retained for Exel Consultancy benefit in accordance with FCA’s RDR rule. The client will receive from the product provider, or from Exel Consultancy information about the commission that Exel Consultancy receives. Exel Consultancy will inform the client of the amount of commission payable to Exel Consultancy on any investment it has arranged for the client. Exel Consultancy retains the right to share this commission with professional connections at its discretion. As this commission is retained, clients are not charged extra for arranging such contracts except by separate arrangement as agreed in advance with the client. If Exel Consultancy receives a commission or other form of benefit from the issuer of a security or from another intermediary, Exel Consultancy will disclose the amount received and the amount charged to the client in accordance with the RDR rule.
  • Please note that Exel Consultancy may vary commission charges from time to time or introduce a new charge in a clear, fair and transparent way in order to comply with any specific regulatory change impacting business operations. Any change will be disclosed and formally communicated to you and will usually take the form of a completed application form, either written or online. However, if the commission charge is part of a restructuring of the charges you are already paying, as a result of regulatory changes, then provided the overall cost to you remains unchanged or is lower, we will notify you in advance but will not require your written consent. Please note that unit cancellation may be used to pay for service charges.
  • Exel Consultancy will supply, on demand, to the client or agent, copies of contract notes, vouchers, and entries in books and records for a period of five years from the date of each transaction.
  • If Exel Consultancy is unable to conduct investment business due to illness or any other reason for a period of more than twenty-one days, Exel Consultancy has made a locum arrangement with another regulated firm to carry out its business obligations.
  • To prevent or detect fraud and money laundering activities, or to assist in verifying your identity, Exel Consultancy may make searches at credit reference or fraud prevention agencies or at the electoral register.
  • You should assume that all telephone calls, website use and emails between you and Exel Consultancy will be recorded. These recordings will be the sole property of Exel Consultancy and may be used for training purposes or as evidence in the event of a dispute.
  • Exel Consultancy and its agents may process any personal data (as defined by the Data Protection Act 1998) provided by you in connection with the services provided. Your personal data includes any information which Exel Consultancy holds now or at any time in the future, which comes from, or relates to application forms or other dealings with us; third parties such as credit reference and fraud prevention agencies and the services you receive from Exel Consultancy. We may use your personal data to provide our services to you and for security, payment verification, preventing and detecting money laundering, fraud and other crime, for which purposes we may also pass on your personal data to third parties.

  • These Terms and Conditions are governed by English Law and are subject to the jurisdiction of the English courts.
 
 

GENERAL RISK DISCLOSURE

This general notice provides you with information about the risks associated with all products on the Exel Consultancy website, which you may invest in. To help you understand the risks involved when investing in our products, please read the following risk summary. It is important that you understand the nature of these risks before deciding to invest.

You should not invest in any product from this website unless you understand the nature of the investment you are entering into and the extent of your exposure to risk. You should be satisfied that any product from this website is suitable to you given your financial position and investment objectives and where appropriate you should seek advice in advance of making any investment decisions.

 

  1. LOSS OF INVESTMENT

Investing in the products offered by Exel Consultancy website may involve significant risk of default. In the event of any of these products unable or unwilling to meet payments of interest and capital, it is likely that you may lose all, or part, of your initial investment and receive no outstanding or future interest payments.

If your investment fails, Exel Consultancy will not pay you back your investment. You should only invest an amount that you are willing to lose and should build a diversified portfolio to spread risk.

 

  1. ILLIQUIDITY AND NON-TRANSFERABLE

Investing in the products offered are illiquid. In other words, you cannot trade them, so your money is effectively locked in until the maturity date.

 

  1. CLIENT CLASSIFICATION

Before being allowed to invest, you will need to be classified as an investor type. You will need to provide the relevant information to us, which you warrant to be truthful and accurate, in order that we can classify you. Please follow the steps when signing up to complete this process. If you no longer fall into at least one of the categories of investor available, you must give immediate written notice to Exel Consultancy and you must not access or try to access the service until you fall into one or more of these categories again.

 

  1. PAST PERFORMANCE

Past performance is not a reliable indicator of future results. You should not rely on any past performance as a guarantee of future investment performance.

 

  1. FUTURE PERFORMANCE

Any projections of future performance are based on the internal calculations and opinions are subject to change at any time. Forecasts are not a reliable indicator of future results and should not be relied on.

 

  1. FINANCIAL SERVICES COMPENSATION SCHEME

Investing through our website does not cover you for the Financial Services Compensation Scheme (FSCS).

 

  1. JURISDICTION

The information and services provided on the site are not provided to, and may not be used by, any person or entity in any jurisdiction where the provision or use thereof would be contrary to applicable laws, rules or regulations of any governmental authority or where Exel Consultancy is not authorised to provide such information or services. The products and services described in this website are only available for UK residentials.

All investments can be affected by a variety of factors, including macro-economic market conditions such as the interest or exchange rate environment, or other general political factors in addition to more company or investment specific factors. We refer to the spread of possible returns as volatility.

Interest rates can rise as well as fall. A risk exists with interest rates that the relative value of a security, in particular a bond, will worsen due to an interest rate increase. There can also be a negative impact on other products.

There can be no guarantee that the nature, basis or incidence of taxation may not change during the lifetime of an investment. This may potentially cause current or future tax liabilities. Exel Consultancy does not give tax advice and if you are uncertain about any aspect of how an investment might relate to your own tax position please seek professional tax advice.

 

  1. CONCENTRATION RISK

The risks of investment can be reduced by diversifying your portfolio; that is by investing in a range of instrument classes and within those classes in a range of instruments. If you decide you wish to have a concentrated portfolio this can be expected to mean that your portfolio is more volatile and more risky than it would be in a diversified portfolio.  This concentration can work both against you and in your favour depending on the performance of the specific investments in your portfolio.
